Police Public Records

Police Public records may be requested from the custodian of public records as follows:

 

All requests for police public records will be filled in a timely manner during normal business hours (Monday through Friday, 8:00am – 5:00pm).

Requests may have a delayed response due to the nature of the request, the volume received, and/or the staffing available to process the requests.

If the report is open or a capias has been requested, the report will not be available through the Winter Springs Police Department until the case has a disposition or is closed.

Please Note: Any requests that take longer than 15 minutes to locate and review will require a special service that is determined by an hourly rate. Any requests that have a cost associated will require a deposit or full estimate prior to the request being fulfilled. An estimate will be provided to you prior to any work being completed.

 

RELEASE OF FLORIDA TRAFFIC ACCIDENT REPORTS

Section 316.066, Florida Statutes, governs the completion and subsequent distribution of traffic crash reports. Traffic crash reports are exempt from public disclosure, except for parties involved in the crash and other specific parties outlined in the statute. This statute also provides criminal penalties (third-degree felony) for the unlawful disclosure of confidential personal information and for unlawfully obtaining or attempting to obtain confidential personal information.

Anyone claiming one of the exemptions outlined in the statute must submit a Request for Traffic Crash Report Information waiver in person (which can be found with the Records Department) and present a valid photo ID (or qualifications) when receiving the requested report.

You also have the option to purchase copies of the crash report through Florida’s Official Crash Portal at services.flhsmv.gov

 

BODY-WORN CAMERA AND VIDEO REQUEST FEES

Please be advised that your request would require extensive time and research to provide the video for inspection and/or copying. Redacting any exempt or confidential information will be necessary and will require additional time.

Pursuant to §119.07(4)(d), Florida Statutes, compliance with your request as written will result in a special service charge representing the labor costs actually incurred by this agency for clerical and supervisory assistance attributable to your request.

A deposit of $100.00 is required.

The first fifteen minutes of labor is free of charge and then a fee will be assessed at $25.00 per hour. Please note that the fees may increase depending on the amount of time it will take actually to research and redact the records necessitated by your request. If the deposit amount is exceeded, then additional monies will be requested prior to continued redaction of the video. Any extra monies will be refunded to you at the end of the fulfillment of the public record request.

Please note that if a deposit is not received within 30 days we will consider your request withdrawn.
